Video surveillance: rely on qualified professionals

Responsibilities of those commissioning and owning surveillance systems
When installing, modifying, extending or maintaining a video surveillance system, use specifically authorised designers and installers, who must supply operating and maintenance instructions under Article 8 of Ministerial Decree No. 37 of 22 January 2008.
In workplaces, video surveillance and audiovisual systems may be used solely for organisational and production needs, workplace safety and protection of company assets.
Article 4 of Law No. 300 of 20 May 1970 also applies. Before installation, employers must obtain a collective agreement with the workplace union representation, where present, or specific authorisation from the local National Labour Inspectorate.
Privacy legislation and the entry into force of Regulation EU/679/2016 and subsequent Legislative Decree No. 101 of 10 August 2018 require personal data to be processed fairly for specified, explicit, legitimate purposes, such as performing institutional duties in accordance with legal obligations or with the free and express consent of those filmed.
Relevance and proportionality must also be respected: collect only strictly necessary data and record only indispensable images, positioning cameras and defining recording methods accordingly.
Specific authorised persons must be appointed to use installations and view recordings, except where judicial or police investigations are necessary.
EL.MO entrusts its products to qualified installers capable of performing installations in full compliance with current regulations.
